Loomio Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Loomio website, the parent portal, and any related tools, content, or communications (collectively, the “Services”). The Services are provided by Loomio, Inc., a Delaware corporation (“Loomio,” “we,” “us,” or “our”).
By using the Services, you agree to these Terms. If you do not agree, please do not use the Services. Please also read our Privacy Policy, which explains what information we collect and how we handle it.
1. Loomio is educational, not medical care
Loomio is an educational tool. It offers general information and play-based activity ideas to support early speech and language development. It is not a medical service, and using it does not create a clinical relationship between you and Loomio or any clinician associated with us.
The developmental snapshot is a reflection exercise, not a diagnostic or screening instrument. Its results are not an assessment, a diagnosis, or a treatment plan, and they should not be used to decide whether your child does or does not need professional help.
Nothing in the Services is a substitute for advice from a qualified professional. If you have concerns about your child’s development, speak to your pediatrician or a licensed speech-language pathologist. If you believe your child needs urgent medical attention, contact your local emergency services.
2. Who may use the Services
You must be at least 18 years old to use the Services, and you must be the parent or legal guardian of any child whose information you enter. The Services are designed for adults. They are not directed to children, and children should not use them directly.
By entering information about a child, you confirm that you have the authority to do so.
3. Your account
Some parts of the Services require an account. We sign you in through a link sent to your email address, so keeping access to that inbox secure is how you keep your account secure. You are responsible for activity that happens under your account.
Please give accurate information when you sign up, and let us know if you believe someone else has gained access to your account.
4. Using the Services responsibly
You agree not to:
- use the Services for anything unlawful, or in a way that harms another person;
- copy, resell, or redistribute our activities, content, or materials without our written permission;
- attempt to access accounts, data, or systems that are not yours, or work around any security or access limits;
- interfere with the Services, for example by scraping at scale, overloading our systems, or introducing malicious code;
- present the Services, or anything drawn from them, as clinical advice, assessment, or treatment.
5. What you enter
You keep ownership of the information you enter, including anything you record about your child. You grant us permission to store and process that information so that we can provide the Services to you, and to use it in de-identified, aggregated form to understand how the Services are used and to improve them.
Please do not enter information you would not want stored, and avoid entering sensitive details that the Services do not ask for. How we handle your information is described in our Privacy Policy.
6. Our content
The Services, including the activities, written guidance, illustrations, design, and the Loomio name and logo, belong to Loomio or our licensors and are protected by copyright and other laws.
You may use our activities with your own family, and print or save them for that purpose. You may not republish them, sell them, or use them in a commercial or professional setting without our written permission.
7. Services provided by others
We rely on third parties to run the Services, including providers for hosting, databases, authentication, analytics, and email. Their handling of information is governed by their own terms and policies. We are not responsible for third-party websites or services that we link to.
8. Changes and availability
Loomio is early-stage and evolving. We may add, change, or remove features, and we may suspend or discontinue any part of the Services at any time. We do not promise the Services will always be available, uninterrupted, or free of errors.
We may also modify these Terms. When we do, we will update the date at the top of this page. If a change is significant, we will make a reasonable effort to tell you. Continuing to use the Services after a change means you accept the updated Terms.
9. Ending your use
You may stop using the Services at any time, and you may ask us to delete your account and associated information by writing to hello@loomiohealth.com.
We may suspend or end your access if you breach these Terms or use the Services in a way that risks harm to others or to the Services themselves.
10. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Services will meet your needs, that the information in them is complete or suited to your child, or that any particular result will follow from using them. Children develop at different rates, and general guidance cannot account for an individual child.
11. Limitation of liability
To the fullest extent permitted by law, Loomio and the people who work with us will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of your use of the Services.
To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. You and Loomio agree that any dispute arising from these Terms or the Services will be brought in the state or federal courts located in California.
